Question: I'm contemplating righting an essay on whether or not it should be required, but it would be pointless to write it if the law already exists. Let me know asap! Thanks Ok cool, thanks a million! I know I had to take a wee test for a waiter position.

Drug testing is not mandatory but it is permitted. Personally I believe it is a privacy issue. Unless there is a public safety issue - truck drivers, cops, firemen, tow boat pilots, etc. it should be used only under probable cause. We got Alcohol tested because someone found an empty tequila bottle in the porta-john. then we got drug tested when they found a baggie that tested positive for crack in another one. Our entire 30 man crew tested negative both times.
The drug tests your probation officer uses are probably exactly the same as the home kit, with instant results. If they send it off to the lab, that doesn't necessarily mean that anything will show up. Most of the home test kits are as accurate as lab tests. If you passed at home, you will pass at the office. There are lab tests that can detect drug metabolites for quite some time after, but they are extremely expensive and are NOT used for routine drug testing. If you diluted your urine by drinking a bunch of water or adding some to it when you took your home test, then you can't trust the result. Expect to fail at your PO's office. Clear pee is obvious, and they can refuse to except it. Also, if it is sent to the lab, they check for certain levels of naturally occurring substances in the urine, and if they are low, they will know the sample is diluted and reject it. Once this happens, they will demand a hair test, which you will not pass no matter what you do. Bleach, dyes and shampoos cannot fake the test, and if you shave everything off, you can bet your PO will put you on a detainer until it grows back and he gets a sample.
No law exists to require drug tests except in very specific occupations (such as transport). It is becoming very common for all sorts of businesses to require tests, but that is not law, simply company policy.
No you don't test positive if you are around someone who smokes pot on a daily basis. In fact, my ex boyfriend who had to take a drug test smoked pot daily, tested positive. He used the excuse "I was around my friend in the car while he was smoking pot all day with the windows closed." His counselor said um sorry but that doesn't work that way. You don't test positive if you are around someone smoking pot only if you smoke it and inhale it is what his counselor told him. I have been drug tested for employers after roomates smoked it heavily just like yours and being next to it even though I didn't smoke it. I was worried myself the possibility of testing positive from that, but I didn't. If it is a hair folicule test, then you can test positive. If it is urine I wouldn't worry. Hope I helped. Just in case, yes drink lots of water. 8 glasses of water prior to one hour before the test. Go to the bathroom once. Drink one more glass of water before you go take your test. Believe me that always helps.
No they do not. Many companies require it especially for higher position or ones involving the use of complicated or dangerous machinery but there isn't a mandate in the U.S. that you have to do drug testing and many (most) jobs do not require it.
